OVERVIEW

Welcome to TT PLAYA WEAR. The terms “we,” “us,” and “our” refer to TT PLAYA WEAR. TT PLAYA WEAR operates this website and online store, including the information, content, features, tools, products, and services offered through it (collectively, the “Services”).

Our store is powered by Shopify, which provides the ecommerce platform that enables us to offer our products and Services to you.

These Terms of Service (“Terms”), together with our Privacy Policy, Return & Refund Policy, Shipping Policy, and other policies posted through the Services, describe your rights and responsibilities when using our Services.

By visiting, interacting with, purchasing from, or otherwise using our Services, you agree to these Terms and our applicable policies. If you do not agree, please do not use the Services.

We make reasonable efforts to display and describe our products accurately. However, colors and product appearance may vary depending on your screen, device, display settings, production method, garment material, and other factors.

Many TT PLAYA WEAR products are produced on demand. Minor variations in print placement, embroidery, color, sizing, or appearance may occur as part of the manufacturing and fulfillment process and do not necessarily constitute a defect.

Product descriptions, designs, pricing, availability, colors, sizes, and specifications may be changed at any time without notice. We may discontinue products or limit quantities available for purchase.

SECTION 3 — ORDERS

When you submit an order, you are making an offer to purchase the selected products. We reserve the right to accept, reject, limit, or cancel an order where reasonably necessary, including because of product availability, suspected fraud, pricing or listing errors, payment issues, or fulfillment limitations.

Payment must be successfully authorized before an order can be processed.

Please review your order carefully before submitting it. Because many products are made to order and may enter production shortly after purchase, order changes and cancellations cannot be guaranteed after an order has been submitted.

Returns, refunds, and exchanges are governed by our Return & Refund Policy and applicable law.

SECTION 4 — PRICES, PAYMENTS AND BILLING

Prices, discounts, promotions, and product availability may change without notice.

Unless otherwise stated, displayed product prices do not include applicable taxes, shipping charges, customs duties, import fees, or similar charges.

You agree to provide current, complete, and accurate billing, payment, shipping, and account information.

You represent that you are authorized to use any payment method submitted for a purchase and agree to pay all properly disclosed charges associated with your order.

SECTION 5 — SHIPPING AND DELIVERY

Processing, production, shipping, and delivery times are estimates and are not guaranteed.

Because many TT PLAYA WEAR products are made to order, production time may occur before an item is shipped. Products within the same order may also be produced or shipped separately.

Delivery may be affected by carrier delays, weather, customs processing, holidays, supply interruptions, or circumstances outside our reasonable control.

Customers are responsible for providing complete and accurate shipping information when placing an order.

SECTION 6 — RETURNS AND REFUNDS

Returns, replacements, refunds, exchanges, damaged merchandise, incorrect merchandise, and other product-related claims are governed by our Return & Refund Policy.

Because many products are made specifically for each order, certain products may not qualify for return or exchange due solely to buyer’s remorse, change of mind, or an incorrectly selected size, color, or style, except where otherwise required by applicable law.

SECTION 7 — INTELLECTUAL PROPERTY

The Services and their contents, including TT PLAYA WEAR names, logos, trademarks, designs, artwork, graphics, photographs, product names, slogans, text, videos, and other original content, are owned by or licensed to TT PLAYA WEAR and are protected by applicable intellectual property laws.

You may use the Services for personal, non-commercial purposes only.

Unless expressly authorized in writing, you may not copy, reproduce, modify, distribute, sell, license, publicly display, commercially exploit, or create derivative works from TT PLAYA WEAR content, artwork, branding, designs, or other protected materials.

Shopify and other third-party names, trademarks, and logos remain the property of their respective owners.

We do not control and are not responsible for the content, accuracy, security, availability, products, services, or practices of third-party websites.

SECTION 10 — RELATIONSHIP WITH SHOPIFY

TT PLAYA WEAR is powered by Shopify, which enables us to provide the Services to you. However, purchases made from TT PLAYA WEAR are transactions directly between you and TT PLAYA WEAR.

By using the Services, you acknowledge that Shopify is the ecommerce platform provider and is not the seller of TT PLAYA WEAR merchandise. To the extent permitted by applicable law, Shopify and its affiliates are not responsible for claims, damages, injuries, or losses resulting from products purchased directly from TT PLAYA WEAR.

SECTION 11 — PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy and applicable law.

Because our store is powered by Shopify, certain information may also be collected and processed by Shopify and other service providers used to operate, secure, fulfill, analyze, and improve the Services.

SECTION 12 — FEEDBACK, REVIEWS AND USER CONTENT

If you voluntarily submit reviews, photographs, comments, suggestions, ideas, or other content (“Feedback”), you represent that you have the right to provide that content and that it does not violate applicable law or the rights of another person.

Unless prohibited by applicable law, you grant TT PLAYA WEAR a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, display, adapt, and distribute Feedback submitted to us or through our Services for purposes related to operating, improving, and promoting TT PLAYA WEAR and its products.

We may remove Feedback that we reasonably determine is unlawful, fraudulent, abusive, obscene, defamatory, misleading, infringes intellectual property rights, or otherwise violates these Terms.

SECTION 13 — ERRORS, INACCURACIES AND OMISSIONS

Occasionally, information within the Services may contain typographical errors, inaccuracies, or omissions involving product descriptions, pricing, promotions, availability, shipping charges, production times, or other information.

We reserve the right to correct errors, update information, and, where reasonably necessary, cancel or modify affected orders.

If an order is canceled after payment because of an error on our part, any applicable payment will be refunded.

You may not use the Services for unlawful, fraudulent, abusive, malicious, or unauthorized purposes.

Automated systems must comply with applicable laws and any technical requirements or restrictions established by TT PLAYA WEAR, Shopify, or our service providers.

We may suspend or terminate access to the Services when reasonably necessary because of a violation of these Terms, suspected fraud, unlawful activity, security concerns, or misuse of the Services.

EXCEPT FOR RIGHTS OR WARRANTIES THAT CANNOT LEGALLY BE EXCLUDED, TT PLAYA WEAR MAKES NO EXPRESS OR IMPLIED WARRANTY THAT THE SERVICES WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS ANY WARRANTY, CONSUMER RIGHT, OR REMEDY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

SECTION 18 — LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TT PLAYA WEAR AND ITS AFFILIATES, SERVICE PROVIDERS, CONTRACTORS, LICENSORS, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES.

This limitation does not apply where liability cannot lawfully be excluded or limited.
